Cancellation, Return & Exchange Policy
Applicable to all property listings and auctioned real estate on SaudiAuction.Estate
1. General Policy
Real‑estate transactions in Saudi Arabia are legally binding once payment is completed and the buyer receives confirmation of purchase. Due to the nature of property sales, cancellations, returns, and exchanges are generally not permitted except under specific conditions outlined below.
2. Cancellation Policy
2.1 Buyer‑Initiated Cancellation
A buyer cannot cancel a property purchase after:
Buyer‑initiated cancellations are not eligible for refunds unless covered under Section 4 (Exceptional Cases).
2.2 Seller‑Initiated Cancellation
A seller may cancel the transaction only if:
The buyer fails to complete payment within the required timeframe
The buyer provides invalid or fraudulent documents
The property becomes legally restricted or unavailable
If the seller cancels for reasons unrelated to buyer fault, the buyer will receive a full refund of any payments made.
3. Return Policy
Real‑estate properties cannot be returned once:
The handover is completed
The buyer signs the Handover Confirmation
Ownership transfer begins or is completed
Properties are sold as‑is, based on the listing details and buyer inspection.
4. Exchange Policy
Property exchanges are not allowed under any circumstances. Each listing is a unique asset and cannot be swapped for another property or listing.
5. Exceptional Cases for Cancellation or Refund
A cancellation or refund may be approved only under the following conditions:
5.1 Misrepresentation or Fraud
If the seller:
SaudiAuction.Estate will investigate and may approve cancellation and refund.
5.2 Legal Restrictions
Cancellation may be approved if:
The property cannot be legally transferred
The property is under a government dispute or enforcement order
The seller fails to provide mandatory legal documents (Title Deed, FAL License, Ownership Certificate)
5.3 Seller Non‑Compliance
Cancellation may be granted if the seller:
Refuses to complete the handover
Fails to appear for the scheduled transfer
Cannot prove legal ownership
6. Cancellation Request Process
To request cancellation under exceptional cases:
Submit a formal request within 48 hours of discovering the issue.
Provide supporting evidence (photos, documents, communication logs).
SaudiAuction.Estate will review the case within 7–14 business days.
If approved, the refund will be processed through the original payment method.
7. Non‑Eligible Situations
Cancellation, return, or exchange will not be approved for:
Buyer changing their mind
Buyer failing to inspect the property before bidding
Market price changes
Delays caused by banks or financing
Issues discovered after handover
Buyer dissatisfaction with location, size, or design after purchase
8. Platform Disclaimer
SaudiAuction.Estate acts as a marketplace facilitator. The platform is not responsible for:
Property defects discovered after handover
Buyer or seller negligence
Losses due to improper inspection or due diligence
The platform will intervene only in cases involving fraud, misrepresentation, or violation of policy.
9. Final Decision
All cancellation, return, and exchange decisions are made at the discretion of SaudiAuction.Estate, based on evidence and compliance with Saudi real‑estate regulations.
